BOOKING CONDITIONS
(1) General—All bookings are made between usail2.com a division of Glenn’s Marine Services P/L, hereafter called usail2 and person or persons named in the party details, hereafter called the client. There will be no contract between usail2 and the client until: (a) The booking form and party details is completed by the client and
(b) the appropriate deposit has been received by usail2 and
(c) the booking has been confirmed in writing by letter or email.
(2) Payment—The balance of the invoice is payable not less than 30 days before the scheduled departure date. If the payment has not been received by this date usail2 shall be entitled to cancel the booking and the deposit forfeited.
(3) Cancellations - All cancellations must be in writing and received by usail2 prior to the departure date. Where usail2 is not notified prior to the departure date the total cost of the holiday is forfeited. Cancellation charges are payable as follows from the date of advice to the date of departure.
Over 30 days ……...deposit only
20 - 30 days ……...40% of total charter fee
10 - 20 days ……...60% of total charter fee
Under 10 days ……….80% of total charter fee
No notification ……….100% of total charter fee
Remember insurance cover is recommended and is available against involuntary cancellation.
(4) Alterations— Alterations to cruising dates may be made in writing, but not less than 30 days prior to the departure date. Usail2 will always try to arrange any alterations you may request.
(5) Price Variation - It is usail2’s policy to absorb all of any increased costs, and these will not be passed onto the clients except in the following cases…… Increased costs caused by Government action such as the increased % of GST payable, or other Government regulation will be passed on after the date of your booking.
(6) Cancellation by usail2 - usail2 reserves the right to cancel your cruise because of events beyond its control such as wars, civil disturbances, acts of God, acts of Government or strikes. In this eventuality, usail2 will endeavour to give the client as much notice as possible and shall offer the client an alternative cruise or a full refund of all money paid, less usail2’s reasonable expenses.
(7) Liability and Insurance— Our yachts are fully insured. Usail2 maintains insurance on the fleet of yachts to cover the clients in the event of loss or damage to the yacht and or its equipment. The client, however, shall be liable for the first $500 for the Mangrove Jack Motorsailers and $1000 on the Inspiration 1050 catamarans. Usail2 maintains insurance to cover the clients in the event of damage to property or injuries to third party up to a limit of $5 million. All other insurance, in respect to loss or damage to personal belongings and loss, damage or injury to the client is the responsibility of the client alone and usail2 accepts no responsibility for this. The booking is accepted on the basis that the details provided by the client as to previous sailing experience are accurate and usail2 will not be responsible for any loss suffered by the client, however caused, as a result of the insurers failing to indemnify the insured.
(8) Complaints - Usail2 sincerely hopes you will have no cause for complaint. If a client has a complaint, the matter must be raised with usail2, so that if possible it can be resolved. Should this be impossible then a written complaint must be sent to usail2 not later than 30 days after the cruise, after which no claim can be entertained.
(9) Information - Usail2 honestly believes that the information contained herein is correct. Every care has been taken in compiling the information on our website but usail2 can accept no liability should it prove not to be so.
